Omnibus Plan Change - Plan Change 8 and Plan Change 1

These plan changes introduce a range of amendments targeting specific issues or activities known to be contributing to water quality issues in parts of Otago.

The Omnibus Plan Change - also known as the Water Quality Plan Change - comprises:

  • Plan Change 8 (Water Quality) to the Regional Plan: Water for Otago; and
  • Plan Change 1 (Dust Suppressants and Landfills) to the Regional Plan: Waste for Otago.

These plan changes have been prepared by Otago Regional Council (ORC) to introduce a range of amendments targeting specific issues or activities known to be contributing to water quality issues in parts of Otago. Among other things, the plan changes will improve water quality provisions relating to discharges in various situations including landfill management and on farm storage of farm dairy effluent (for the first time in Otago). They will also prohibit the use of waste oil as a dust suppressant. 

Note: In accordance with section 86B(3) of the Resource Management Act 1991 (RMA), the plan changes have legal effect from the date that the changes were notified. 

About the Omnibus Plan Change  

The Omnibus Plan Change proposes new objectives, policies and rules to the Regional Plan: Water for Otago and Regional Plan: Waste for Otago. ORC has also prepared an evaluation report of the Omnibus Plan Change in accordance with section 32 of the RMA.

Local authority key issues report

Public notification of, and submission process for the Omnibus Plan Change

On 6 July 2020, we publicly notified the Minister's direction on the Omnibus Plan Change. The public submissions period closed on Monday 17 August 2020.

EPA recommendation and Minister's direction Plus

The EPA's advice and recommendation to the Minister under section 144A of the Resource Management Act 1991 (RMA) was made on 8 April 2020. The Minister called in the Omnibus Plan Change as part of a proposal of national significance and directed the matter to the Environment Court for decision under section 142(2) of the RMA, on 8 April 2020.

Service of the public notice Plus

As part of the original notification requirements, we were required to serve a copy of the public notice on certain parties. 

On 19 June 2020, we applied to the Environment Court for a waiver of the service requirements due to practical difficulties of identifying land to which the plan changes relate. On 22 June 2020, the Environment Court issued an order waiving service requirements under section 149C(4)(a) and (b) of the Resource Management Act.
