Proposal to amend the Fire Fighting Chemicals Group Standard 2017

The decision was made to amend the Fire Fighting Chemicals Group Standard 2017.
This group standard regulates the import, manufacture, use, storage and disposal of firefighting chemicals. It currently prohibits firefighting foams containing PFOS (perfluorooctane sulfonic acid) and PFOA (perfluorooctanoic acid).
The proposed amendments add further restrictions on firefighting foams containing fluorinated organic compounds (PFAS chemicals).
These amendments follow our national investigation into the storage and use of legacy firefighting foams containing PFOS and PFOA at various locations throughout New Zealand.

The Decision-making Committee have decided on amendments to the Fire Fighting Chemicals Group Standard 2017.
4 December 2020
The DMC released the fifth Direction and Minute which directs that the hearing should be closed. Any decision on the group standard amendment made by the DMC will be published within the statutory 30 working day from the close of hearing as set out in the HSNO Act.
12 November 2020
The DMC released the fourth Direction and Minute which directs that the late information from three parties, has been accepted by the DMC.

The public hearing for this application was held on 5 and 6 November 2020.

The DMC released the third Direction and Minute which directs that the late information from Mike Wilson, in relation to his submission, was accepted by the DMC.

We published an updated proposed draft group standard and an update report. The update report reflects our assessment of the updated proposed amendments, incorporating an assessment of submissions and new information on the regulation of firefighting foams internationally.
We have also released our Notice of hearing document which provides information on the hearing and the schedule of presentations.

The DMC released the second Direction and Minute.
The Direction and Minute directs that the hearing for this amendment is to take place on 5 and 6 November 2020, with submitters to present remotely or in person in Wellington.

The DMC released the first Direction and Minute.
The Direction and Minute outlines the current proposed date for a hearing and acknowledges that the COVID-19 pandemic may affect the ability of parties and submitters to participate in the process for the amendment and hearing.
The DMC is seeking input from all parties to the process, to better understand their ability to participate in the application and hearing processes while the COVID-19 pandemic may be affecting their ability to work.
We received 20 public submissions, which we are now reviewing and analysing.
We will produce a report outlining our updated proposal for the amendment of the Group Standard. This report will include review and analysis of the submissions.
The submission period closed on 16 December 2019.
The closing date for submissions was originally Monday 2 December 2019 but we extended this by two weeks to Monday 16 December 2019. This is to allow more time for interested parties to make submissions on the proposed amendments.
