Draft Report and Decision

The Board of Inquiry for the East West Link proposal released its Draft Report and Decision (dated 8 November 2017) on 14 November 2017.

In summary, the Board of Inquiry:

  • Confirmed two Notices of Requirement relating to the East West Link proposal subject to conditions contained in Volume 3 of the Draft Report and Decision
  • Granted Resource Consents relating to the East West Link proposal subject to conditions contained in Volume 3 of the Draft Report and Decision.

Next steps

Under section 149Q of the Resource Management Act 1991 (RMA), the Draft Report and Decision were provided to the New Zealand Transport Agency (the applicant), Auckland Council, all submitters, the Minister for the Environment, Minister of Conservation and the landowners and occupiers directly affected by the draft decision.

The Environmental Protection Authority (EPA) invited these parties on the 14 November 2017 to comment on minor or technical aspects of the report to the EPA.

The period for comments closed on 12 December 2017. In accordance with section 149R(1) of the RMA, the Board will consider any comments received and then make its decision, and prepare a final report.

Comments on the Draft Decision and Report Plus

Under section 149Q(4) of the Resource Management Act (RMA) the Environmental Protection Authority (EPA) invited comments on minor or technical aspects of the report from the New Zealand Transport Agency (the applicant), Auckland Council, all submitters, the Minister for the Environment, Minister for Conservation and the landowners and occupiers directly affected by the draft decision (as outlined in section 149Q(3) of the RMA). 
Comments from nine parties were received by the EPA at the close of the comments period (12 December 2017). In accordance with section 149R(1) of the RMA, the Board will consider any comments received and then make its decision and prepare a final report.
