The appeal by the Society for the Protection of Aotea Community and Ecology Incorporated was withdrawn by the appellant, and judicial review proceedings have instead been filed with the Court.

The High Court have set the hearing date for 22 and 23 July 2019 to hear the appeals of the EPA's decision to grant a marine consent to Coastal Resources Limited.
Two appeals were lodged on 7 March 2019 with the High Court in Wellington of the EPA's decision to grant a marine consent to Coastal Resources Limited under the Exclusive Economic Zone and Continental Shelf (Environmental Effects) Act 2012 (EEZ Act). The High Court set the hearing date for 22 and 23 July 2019 to hear the appeals of the EPA's decision to grant a marine consent to Coastal Resources Limited. Any requests for documentation relating to the appeals should be directed to the High Court in Wellington or the appellants rather than the EPA.

On 5 March 2019 an amended marine dumping consent was issued to Coastal Resources Limited (CRL) to correct a minor error in the dumping point coordinates specified in Row E of Condition 22. The amendment to the marine dumping consent did not affect the decision made by the Decision-making Committee on 5 February 2019, or the period of time to appeal the decision.

On 5 February 2019, the Decision-making Committee appointed by Environmental Protection Authority granted subject to conditions the application for marine dumping consent to CRL. The consent is for the dumping of 250,000 cubic metres of dredged material per annum at the Northern Disposal Area, which is located 25 km east of Great Barrier Island.
