Permitted marine structures are regulated under the Exclusive Economic Zone and Continental Shelf (Environmental Effects - Permitted Activities) Regulation 2013.
Under regulation 6 maintenance and repair of permitted marine structures are permitted activities and you don't need our approval to carry out this work.
Work to alter, extend or remove a permitted marine structure is also a permitted activity under regulation 6, as long as you comply with certain conditions. These include pre- and post- activity requirements.
Your pre-activity requirements are set out in Schedule 1 of the regulations. These includes notifying the EPA and iwi, no later than 40 days and 25 days respectively, before activity commences. We will provide you with a list of iwi to contact, and you must report back to us on your contact with iwi no later than five days before activity commences.
Your post-activity requirements are set out in Schedule 4 of the regulations. These include reporting on the activity to us within 60 days of completion.
