The expert consenting panel appointed to determine the Kohimarama Comprehensive Care Retirement Village application has made its decision. Read the decision report and information on appeals.
The EPA received a request from the applicant to correct minor errors in the conditions of the resource consents, which the EPA passed on to the panel. The panel resolved to correct the minor errors, and issued Minute 8 recording this on 8 June 2021.

The EPA received correspondence from a party whose comment was invited in accordance with clause 17(2) of Schedule 6 of the Act, which we passed to the panel. A Minute addressing this correspondence was released on 1 June 2021.
In this Minute, the panel outlines their decision to correct minor errors in Appendix 2 of the decision. As such, the below link “Amended Kohimarama Comprehensive Care Retirement Village record of decision” (which was released on 1 June 2021), supersedes and replaces the “Kohimarama Comprehensive Care Retirement Village record of decision” released on 12 May 2021.

The expert consenting panel appointed to determine the Kohimarama Comprehensive Care Retirement Village application has completed its consideration of the application and has made its final decision.
On 12 May 2021, the expert consenting panel granted in part (subject to building design modifications through reduction in the height of two buildings), subject to the conditions listed in Appendix 3 of the record of decision, the application from Ryman Healthcare Limited to construct a retirement village in Kohimarama Auckland.

The expert consenting panel’s decision can be appealed to the High Court in whole or in part on questions of law only.
Any of the following persons may appeal:
(a) the consent applicant or requiring authority, as the case requires
(b) any relevant local authority
(c) the Attorney-General
(d) any person or group that provided comments in response to an invitation given under clause 17(2)
(e) any person who has an interest in the decision appealed against that is greater than that of the general public.
A notice of appeal must be filed with the Registrar of the High Court within 15 working days after the date the person is notified of the expert consenting panel’s decision. A copy of the notice of appeal must also be served on the EPA. Appeals can be served on the EPA by sending them to Rymankohimarama.FastTrack@epa.govt.nz or by post to:
