On 12 October 2020, NZTA made an application for resource consents and lodged two notices of requirement for the Te Ara Tupua - Ngauranga to Petone shared path.
On 19 October 2020, the EPA determined that the application and notices of requirement complied with the requirements set out in clause 3(1) of Schedule 6 of the Act, and could be provided to the Expert Consenting Panel appointed to determine the application.

The expert consenting panel directed the EPA to request information from the applicant Waka Kotahi New Zealand Transport Agency (NZTA).

On 19 January 2021, NZTA provided a Memorandum of Counsel in response to further information request 4, in relation to clarification of the timing and anticipated approach to applying for additional consents to implement the mussel bed programme or other components of the offset mitigation/compensation.

On 13 January 2021, NZTA provided a Memorandum of Counsel, Management Plan Sequencing, Management Plan Interrelationships and Appendix B Conditions in response to further information request 3. As a result of the further information request, NZTA has made a minor amendment to a condition as marked in Appendix B (below).

On 20 November 2020, NZTA provided the EPA with an amended set of proposed conditions, as a minor administrative error had been discovered with the combined conditions that NZTA submitted with the application.
