Working Safer Reforms update 

Approvals process - December 2017
The EPA and WorkSafe are gearing up for some changes to the application process from 1 December. While people making an application probably won’t notice the change, behind the scenes WorkSafe and the EPA will be working closer than ever. When the EPA receives a new application for a hazardous substance approval WorkSafe will make sure the requirements will sufficiently protect people carrying out work-related activities with the substance.

Focus on the Safety Data Sheets Notice
This month we're looking at the Safety Data Sheet Notice and what changes the notice makes to the rules. This notice sets the rules for the format and content of a safety data sheet (SDS). It is similar to the existing group standard provisions.

What will be changing
The notice requires all SDSs to be in the 16-header GHS format. Either the HSNO or GHS classification must be provided in Section 2 of the SDS, along with the GHS signal word, and hazard and precautionary statements. Compared to current requirements, the notice includes more details on the specific information required in some sections of the SDS. The notice will allow GHS-compliant SDSs from Australia, EU, Canada, and USA as long as some New Zealand specific information is also included.

Recent decisions for publicly notified applications are listed on the "recent hazardous substances application and reassessment decisions" page of the EPA website as they are released. Below this section is a monthly summary of all hazardous substance applications by calendar month, with the application number linking to the application summary and documents. The decisions for August 2017 are listed below, or you can go to our website to view decisions from previous months. Go to the recent decisions page.

Decisions on Hazardous Substances applications in September 2017
Decisions were made on the following hazardous substances applications in this period:

APP203303 by DuPont (New Zealand) Limited to determine if grounds exist for the reassessment of Exirel - approval code: HSR100857. Exirel contains 100 g/L cyantraniliprole in the form of a suspo-emulsion.
Decision: Grounds exist for reassessment and decision notified on 1 September 2017

APP203236 by PPG Industries New Zealand Limited to determine if 'Sigma Ecofleet 290S Redbrown' is hazardous
Decision: Determination made and decision notified on 1 September 2017

APP203139 by Altex Coatings Limited to import or manufacture Altex Ablative Antifouling Range LO, an antifouling paint that contains 42.9% cuprous oxide and 2.7% thiram as the active ingredients.
Decision: Approved with controls and decision notified on 1 September 2017

APP203123 by Botry-Zen Limited to manufacture BOTRY-Zen® as a water dispersible granule formulation, containing 45% of the active ingredient Ulocladium oudemansii U3
Decision: Approved with controls and decision notified on 12 September 2017

APP203385 by Tui Products Limited to  import or manufacture for release a soluble concentrate containing 7.2 g/L glyphosate present as the isopropylamine salt for use as a herbicide by home gardeners.
Decision: Approved with controls and decision notified on 12 September 2017

APP202989 by AgriHealth NZ Limited to import Stenorol, a veterinary medicine premix for use in poultry. Stenorol contains 6g/kg halofuginone hydrobromide
Decision: Approved with controls and decision notified on 18 September 2017

APP203237 by PPG Industries New Zealand Limited to determine if 'Sigma Ecofleet 290S Black' is hazardous.
Decision: Determination made and decision notified on 19 September 2017

APP203209 by Adama New Zealand Limited to determine if 'Aphidex 800 WG' is hazardous.
Decision: Determination made and decision notified on 20 September 2017

APP203230 by Zelam Limited to determine if 'Rampage Encaps NF' is hazardous.
Decision: Determination made and decision notified on 22 September 2017

APP202695 by Agroquimicos de Levante SA to  import AFE-HFP containing 570g/kg chloropicrin and 380 g/kg 1,3,-dichloropropene for use as a pre-planting soil fumigant for the control of a range of soil borne diseases, plant parasitic nematodes, symphylans, wireworms and suppression of weeds.
Decision: Approved with controls and decision notified on 22 September 2017

Withdrawn hazardous substances applications
No hazardous substance applications, previously notified, were withdrawn in this period.

Amendments to hazardous substances approvals
No amendments were made under section 67A of the HSNO Act for minor or technical errors, decided by the EPA or the Chief Executive under delegated powers from the EPA during this period.
