Working Safer Reforms Update
Health and safety at Work (Hazardous Substances) Regulations  

The Health and Safety at Work (Hazardous Substances) Regulations have now been published. These regulations come into force 1 December 2017.

The rules to protect people from workplace activities involving hazardous substances will be under these new regulations and be implemented by WorkSafe New Zealand, rather than under HSNO, implemented by the EPA.

Call for information - Paraquat
The EPA is seeking information about herbicides containing paraquat, to help us develop an application for a reassessment of the approvals of paraquat and paraquat-containing substances. Paraquat has long been used in New Zealand as a general purpose herbicide.

It is used in forestry, ground, vine and tree crops, pasture renewal and to remove weeds in drains, waterways and along fence lines. In assessing the risks associated with a new pesticide containing paraquat, the EPA found them to be considerably higher than previously thought.

It declined that application, and is using the new risk analysis to inform its application for a reassessment of paraquat and paraquat-containing substances. For further information, please see our website

APP203024 by Adria New Zealand Limited to import Ethosin 500SC herbicide containing 500 g/L of the active ingredient ethofumesate in the form of a suspension concentrate to control various weeds in fodder beet and red beet.
Decision: Approved with Controls and decision notified on 1 June 2017

APP203147 by IPPC to determine if TERWET® 157 is hazardous.
Decision: Determination Made and decision notified on 2 June 2017

APP203240 by Adria New Zealand Limited to import Varicur 450EW fungicide, containing 450g/litre of the active ingredient prochloraz in the form of a suspension concentrate, to control diseases in barley, wheat and avocados.
Decision: Approved with Controls and decision notified on 6 June 2017

APP202844 by Syngenta Crop Protection Limited to import Barricade Herbicide containing 480 g/L of prodiamine in the form of a suspension concentrate for use as a pre-emergent herbicide for control of weeds in established turf, garden beds and nursery pots.
Decision: Approved with Controls and decision notified on 7 June 2017

APP203181 by Zelam Limited to import or manufacture an experimental pesticide Tnl 3614 for use in trials under containment.
Decision: Approved with Controls and decision notified on 12 June 2017

APP203132 by Dow AgroSciences (NZ) Ltd. to import or manufacture in containment, the product Garlon FallowMaster Herbicide, an end-use agricultural emulsifiable concentrate containing 755 g/LTriclopyr butoxy-ethyl ester.
Decision: Approved with Controls and decision notified on 14 June 2017

APP203198 by PGG Wrightson to determine if STINGER 510 - GH is hazardous.

APP203298 by Grosafe Chemicals Limited to determine if grounds exist to reassess EnSpray 99 ® (HSR100946).

APP203074 by Adama New Zealand Limited to import Adama Trifluralin 600 Herbicide, a pre-plant, pre-emergence herbicide containing 600g/L trifluralin in the form of an emulsifiable concentrate for the control of certain germinating grasses and broadleaf weeds in agricultural and horticultural crops.
Decision: Declined and decision notified on 28 June 2017

APP203099 by STM Group NZ Limited to import Expra Natural (with 100 % Natural Pyrethrins), an aerosol insecticide spray containing a pyrethroid insecticidal active to be used by commercial and domestic users for the control of a variety of flying and crawling pests.
Decision: Approved with Controls and decision notified on 30 June 2017

APP203253 by Landcare Research New Zealand Limited to manufacture and field trial use of a synthetic possum lure to determine whether the synthetic version is more attractive than existing visual and food lures in a field setting.
Decision: Approved with Controls and decision notified on 30 June 2017

Withdrawn hazardous substances applications
No hazardous substance applications, previously notified, were withdrawn in this period.

Amendments to hazardous substances approvals
The following amendment was made under section 67A of the HSNO Act for minor or technical errors, decided by the EPA or the Chief Executive under delegated powers from the EPA during this period.

APP203112 by Shandong Rainbow International Co Limited to amend Hambeet HSR101207 (APP203112) to change the minimum interval between applications.
Decision: Decision Made and notified on 14 June 2017
