Territorial authorities are responsible for enforcement:
- in or on any premises situated within their district (other than those premises mentioned above)
- those premises specified above where the function, power or duty has been transferred to the territorial authority by another enforcement agency.
The territorial authority may also enforce the HSNO Act if they are on the premises for the purpose of enforcing the Resource Management Act (RMA).
Each regional council may enforce the HSNO Act if they are on the premises for the purpose of enforcing the provisions of the RMA, or in or on those premises mentioned above if the function, power or duty has been transferred to the them by another enforcement agency.
