The Board of Inquiry released its final decision report on the Men’s Prison
at Wiri Proposal on 26 September 2011, as required under section 149R of the RMA.

The final report and decision has been provided to the Minister of Corrections, Auckland Council, all submitters, the Minister for the Environment, and all landowners and occupiers directly affected by the decision.
These parties may appeal the Board’s decision to the High Court, but only on a question of law. Appeals must be filed within 15 working days of receiving the final report and decision.

A fee is required for filing an appeal. Parties considering an appeal should contact their solicitor, the New Zealand High Court or visit www.justice.govt.nz for details. Section 300 of the Resource Management Act 1991 outlines what a notice of appeal shall specify, who must be served and relevant timeframes. The High Court Rules (schedule 2 to the Judicature Act 1908) contain other relevant requirements.
